Terms of Use
1. Accepting these terms
By creating an account or using Tokay you agree to these Terms of Use and to our Privacy Policy. If you do not agree, do not use the app.
You must be at least 13 years old to use Tokay.
2. Your account
You are responsible for keeping your password secure and for activity that happens under your account. One account is for one person; do not share credentials. Tell us promptly at flegmate00@gmail.com if you believe your account has been compromised.
You can delete your account at any time from Settings → Delete account. Deletion is permanent and cannot be undone.
3. Subscriptions and billing
Tokay offers an optional paid subscription that unlocks additional features. The exact plan names, durations and prices are shown in the app before you purchase, in your local currency, and are the definitive statement of what you are agreeing to pay.
- Payment is charged to your Apple Account when you confirm the purchase.
- Subscriptions renew automatically. Unless auto-renew is turned off at least 24 hours before the end of the current period, the subscription renews and your Apple Account is charged for another period.
- Renewal is charged within 24 hours of the end of the current period, at the price for the plan you are on.
- If a free trial or introductory offer is provided, any unused portion is forfeited when you purchase a subscription covering the same period.
- Prices may change. We will tell you in advance, and a price change never applies to a period you have already paid for.
4. Cancelling
Manage or cancel your subscription in the App Store, under your Apple Account subscriptions. Apple does not permit an app to cancel a subscription on your behalf, so cancelling must be done there.
Cancelling stops the next renewal. You keep access until the end of the period you have already paid for.
Deleting your Tokay account does not cancel your subscription. If you delete your account without cancelling, Apple will continue to bill you.
5. Refunds
Purchases made through the App Store are handled by Apple, and refunds are at Apple's discretion under their policies. Request one at reportaproblem.apple.com. We cannot issue refunds for App Store purchases ourselves.
Statutory withdrawal or cancellation rights you have under consumer law in your country are not affected by this section.
6. Acceptable use
You agree not to:
- use the service unlawfully, or to harass, abuse or harm anyone;
- attempt to bypass usage limits, create accounts in bulk, or otherwise interfere with the fair operation of the service;
- probe, scan, overload or disrupt our systems, or attempt to gain unauthorised access to any account or data that is not yours;
- scrape, resell or redistribute content from the service;
- reverse engineer the app except to the extent that applicable law expressly permits it.
7. Content and AI output
Tokay uses large language models to simplify, translate and define text. AI output can be wrong. Translations, definitions and simplified articles may contain errors, and you should not rely on them where accuracy matters — for anything medical, legal, financial or otherwise consequential, consult a qualified source.
Articles in the feed may summarise or adapt material from third-party publications. Copyright in the underlying material remains with its owner. If you own material you believe is used improperly, contact flegmate00@gmail.com and we will remove it.
8. Intellectual property
The Tokay app, its name, design and software remain ours. Your subscription grants you a personal, non-transferable, revocable licence to use the app for its intended purpose — it does not transfer ownership of anything.
Content you create — your saved words, your notes — remains yours. You grant us only the licence needed to store it and show it back to you.
9. Suspension and termination
We may suspend or terminate an account that breaches these terms, that is being used to abuse the service, or where we are required to do so by law. Where it is reasonable to do so, we will tell you why and give you a chance to put it right.
We may also discontinue Tokay entirely. If we do so while you hold an active paid subscription, we will give reasonable notice and will not charge you for a period we do not deliver.
10. Disclaimer
Tokay is provided "as is" and "as available". To the fullest extent permitted by law we make no warranty that the service will be uninterrupted, error-free, or that it will meet your particular learning goals. Nothing here excludes any warranty that cannot lawfully be excluded, and if you are a consumer your statutory rights are unaffected.
11. Limitation of liability
To the fullest extent permitted by law, our total liability arising out of or relating to Tokay is limited to the greater of the amount you paid us in the twelve months before the claim, or EUR 50. We are not liable for indirect or consequential loss, or for lost data or profits.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
12. Governing law and changes
These terms are governed by the laws of Hungary, without regard to conflict of law rules. If you are a consumer, you keep the protection of the mandatory laws of your own country of residence, and you may bring proceedings there.
We may update these terms. If a change materially affects your rights we will notify you in the app before it takes effect. Continuing to use Tokay after that means you accept the updated terms.
